Contractual and Regulated, not Discretionary and Unregulated

With indemnity, it is vital you understand exactly what you are paying for and the cover you are getting. You need to be sure that if you ever require your indemnity, it is going to be there to support you.

A Primus policy is a legally binding, contractual insurance policy. If you meet the terms, our insurers legally have to assist you. A Defence Union Agreement is discretionary, they decide whether to assist you and to what extent. They may decide not to assist you at all.

Primus is regulated by the Financial Conduct Authority. This means we follow strict guidelines to protect healthcare professionals like you, ensuring you are always treated fairly.

It isn’t just us that thinks relying on discretionary cover, in the hope that they will assist you, is unsuitable for the current indemnity market. The government also has concerns about the stability of the current forms of indemnity cover provided by Defence Unions, specifically highlighting the following issues:

  • the indemnity providers who provide cover for many healthcare professionals do so under discretionary indemnity arrangements meaning that, unlike commercial insurance companies, they have no contractual obligation to meet the cost of any claim against the professionals they cover;
  • such indemnity providers have no legal obligation to ensure they have the reserves to cover the cost of claims, raising the risk of a patient, ultimately, being unable to access appropriate compensation
  • they do not have to disclose their full financial position, meaning that healthcare professionals may be unaware of the extent of their financial cover
  • they are not subject to regulation on financial conduct and fair treatment, leaving healthcare professionals at risk of unfair treatment.
